Do grandparents have the right to access their grandchildren?
The short answer is no. Grandparents don’t have a legal “right” to access their grandchildren. However, they do have standing, which means they can apply to the court for parenting orders under Section 65C of the Family Law Act 1975 (Cth).
It’s important to know that the rights in family law always belong to the child. The court’s priority is ensuring the child’s welfare and best interests, which includes fostering meaningful relationships with significant people in their lives, like grandparents, as long as it’s safe and beneficial for the child.
Grandparent’s rights in QLD: what is “standing”
Having standing allows grandparents to seek court orders regarding time with their grandchildren or involvement in their upbringing. This doesn’t mean the court will automatically grant access—it simply gives grandparents the opportunity to present their case.
The court will look at what’s best for the child. Factors such as the child’s safety, well-being, and emotional needs will always take precedence. The child’s right to have a relationship with their grandparents is considered within this framework.
How can grandparents build or maintain relationships with their grandchildren?
